Аbout the requirements of the legislation of Ukraine
The Law of Ukraine "About Legal Status of Foreigners and Stateless Persons" determines the grounds for the stay of foreigners, stateless persons on the territory of Ukraine and the issuance of a temporary residence permit.
One of this reason is employment.
The procedure for issuing permits for using labor by foreigners is determined by 42th of Article of the Law of Ukraine "About Employment". An employer can apply for a permit from 1 month to 3 years, depending on the category of foreign employee. More than one work permit may be issued for one foreigner. If the employer uses the labor of a foreigner on the terms of the labor contract without work permit, the employer is charged a fine for each foreigner in the amount of twenty minimum salaries.
When applying for a foreigner’s work permit, the employer must notify The Employment center of the employment of such an employee. Compulsory payment of salaries to a foreign employee in the amount established by law. If the company is checked by the competent authorities and the fact of non-payment of a salary to a foreigner is revealed, the work permit will be canceled. As a result, the cancellation of a work permit cancels a temporary residence permit.
The registration and issuance of a temporary residence card in Ukraine for foreigners is determined by the Resolution of the Cabinet of Ministers of Ukraine dated 25/04/2018 No. 322. With the entry into force of this resolution, it became possible to register a temporary residence permit for children under 16 years old. If foreigner has work permit issued for a period of 3 years, the foreigner also receives a temporary residence permit for 3 years. One of the required documents for applying for a temporary residence permit is valid medical insurance policy that covers the entire period of a foreigner's stay in Ukraine.
The registration and issuance of permanent residence permit in Ukraine for foreigners is determined by resolution of the Cabinet of Ministers of Ukraine of 04.25.2018 No. 321. A permanent residence card is issued for a period of 10 years. It is possible to apply for a permanent residence card in Ukraine if you have permission to immigrate to Ukraine, which is issued on the basis of the Law of Ukraine "About Immigration".
